Made Somewhere offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policy referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. Any new features or tools added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time at this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. Our store is hosted on Shopify. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Article 1 - General

These General Terms and Conditions apply to all use of the Madesomewherestudio.nl website and to all offers and quotations and to all agreements concluded between you and Madesomewherestudio.nl. We reserve the right to refuse service to anyone for any reason at any time.

Article 2- Online store conditions

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state of residence, or that you are the age of majority in your state of residence and you have given us your consent to allow any of your minor dependents to use this site to be used. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You may not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

Article 3 - Offers

3.1 All offers on the website are without obligation, unless expressly stated otherwise. Offers do not automatically apply to repeat orders.

3.2 Made Somewhere cannot be held to its offers if you could reasonably have understood that the offer contains an obvious mistake or typo.

3.3 The prices stated on the website include VAT. A contribution to the shipping costs will be stated separately to you prior to the time of ordering. This is a fixed amount of €5.95 (home delivery) or €4,95 (post point). No shipping costs are charged for orders over €75.

Article 4 - Data

4.1 You must ensure that your information, including but not limited to e-mail address, address details and bank account number, is complete, correct and up to date. You also guarantee that you are legally authorized to use the Website in any way.

4.2 Made Somewhere guarantees that all your data will be treated with the utmost care and that this data will not be passed on, resold or otherwise made available to third parties without your prior consent.

4.3 Made Somewhere will process your data and include it in its file in order to fulfill its obligations arising from the agreement it has concluded with you and/or to process your request. In addition, your e-mail address can be used to inform you of certain products and services that may be attractive to you, unless you have not given permission for this.

4.4 You can always view your own data and change it if desired on the website.

Article 5 - Prices

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content) without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Article 6 - Conclusion of the agreement

6.1 The agreement is concluded upon Made Somewhere's receipt of your order.

6.2 Changing an agreement is only possible if this has been expressly accepted by Made Somewhere.

Article 7 - Delivery

7.1 The order will be delivered to your home, unless you have indicated on the Website that you will collect the order yourself or that the order should be delivered to a different delivery address. The delivery period is a maximum of 5 days.

7.2 You are obliged to accept the purchased products at the time they are made available to you.

7.3 If you refuse to accept delivery or fail to provide information or instructions necessary for delivery, the products intended for delivery will be stored at your risk and expense.

7.4 If you have provided an incorrect address for delivery, the additional shipping costs will be at your expense.

7.5 If the maximum delivery time of 10 days is exceeded, you have the right to terminate the agreement free of charge. Provided this has not already been indicated in advance. To do this, you must send an email to Made Somewhere. In that case, any payments will be returned to you within 10 days of notification.

Article 8 - Accuracy, completeness and timeliness of information.

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information is necessarily not current and is provided for reference purposes only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Article 9 - Risk during transport

During the transport of the products, Made Somewhere will bear the risk in the event of damage. If you receive an incorrect or damaged item, please contact us as soon as possible with your order number and a photo of the item. After 30 days, we cannot provide a full replacement or refund for products that wear out over time. It may take 2-3 business days for your inquiry to be reviewed.

Article 10 - Cooling-off period

10.1 You are entitled to terminate the agreement within 7 days of receipt of the product in question without giving any reason. Made Somewhere will then refund the purchase amount within 14 days of receipt of the returned product, provided that the product in question is undamaged, not worn or otherwise clearly used or modified and is provided with the original packaging and (information) cards. You will receive a link to the returns form with your receipt.

10.2 The costs of returning the product in question are at your own expense.

10.3 Sale items cannot be returned.

Article 11 - Guarantees

11.1 Made Somewhere guarantees that the products to be delivered meet the specifications stated on the website.

11.2 You must inspect the delivered product at the time of delivery, but in any case within as short a period as possible. You should also investigate whether the quality and quantity of the delivered goods correspond with what was agreed, or at least meet the requirements that apply in normal (trade) traffic.

11.3 If it appears within 7 days after delivery that the products do not meet the specifications stated on the website, Made Somewhere will ensure that the amount paid by you will be returned within 30 days of receipt of the products. You may also, at your option, request Made Somewhere to replace or repair the affected product. This warranty period is only longer if the manufacturer of the product in question gives a warranty of more than 7 days.

11.4 The warranty referred to in this article lapses if the defect has arisen as a result of improper or improper use or if, without written permission from Made Somewhere, you or third parties have made changes or attempted to make changes to the product in question or this have used the product for purposes for which it is not intended.

Article 12 - Retention of title

Made Somewhere remains the full owner of the delivered product until the purchase price has been paid in full.

We reserve the right to limit the quantities of any products or services we offer. All descriptions of products or product pricing are subject to change at anytime without notice. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Article 14 - Payment

14.1 During the conclusion of the agreement, you determine how payment will be made. You can choose from different payment options to pay for the order.

14.2 Made Somewhere will only deliver the product when payment has been received.

Article 15 - Collection costs

If you fail to meet your payment obligations, Made Somewhere can not only claim statutory interest on the amount owed, but also all reasonable costs that Made Somewhere must incur in obtaining its claim out of court. The collection costs are set at at least 15% of the principal amount; If Made Somewhere can demonstrate that it has had to incur higher costs, these are also eligible for reimbursement.

Article 16 - Intellectual property rights

16.1 The (intellectual property) rights relating to the website, including the rights to the texts, images, design, data files, photos and other (still and/or moving) images, formats, software, brands (including domain names) and other materials, belong to Made Somewhere, its licensors, the manufacturers of the relevant products and/or third parties.

Article 17 - Liability

17.1 If products supplied by made somewhere are defective, made somewhere's liability towards you is limited to what is arranged in these General Terms and Conditions under Article 9 (Guarantees).

17.2 made somewhere's liability for direct or indirect damage is in any case always limited to an amount equal to the purchase price of the defective product, unless the damage is due to intent and/or gross negligence, or improper or improper use by yourself.

20.3 Made Somewhere is entitled to transfer the rights and obligations under the agreement with you to a third party by a single notification to you.

20.4 If and to the extent that any provision of the General Terms and Conditions is declared null and void or annulled, the other provisions of these General Terms and Conditions will remain in full force and effect. Made Somewhere will then establish a new provision to replace the void/nullified provision, whereby the scope of the void/nullified provision will be taken into account as much as possible.

Article 21 - Applicable law and competent court

Dutch law applies to these General Terms and Conditions. Any disputes will be submitted to the competent court. These General Terms and Conditions can be adjusted by Made Somewhere at any time. Made Somewhere therefore recommends that you regularly review the General Terms and Conditions.
